The U.S. Department of Energy (DOE) Oak Ridge Office of Environmental Management (OREM) is building a new landfill to dispose of their radioactive, hazardous, and toxic wastes in Oak Ridge. They are running out of available space at the current landfill, the Environmental Management Waste Management Facility (EMWMF). DOE calls the new landfill the "Environmental Management Disposal Facility" or "EMDF". Like the EMWMF, the EMDF was approved under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Also known as “Superfund,” CERCLA governs the cleanup of hazardous waste sites.
On September 30, 2022, the U.S. Department of Energy (DOE), the U.S. Environmental Protection Agency (EPA), and the Tennessee Department of Environment and Conservation (TDEC) signed a Record of Decision (ROD) for the Environmental Management Disposal Facility (EMDF). The ROD explains how the DOE, EPA, and TDEC selected onsite disposal as the best way to manage soil and building demolition debris generated by future environmental cleanups on the Oak Ridge Reservation (ORR). The new landfill will only accept waste from ORR cleanups managed under CERCLA, also known as Superfund. These cleanups and associated waste disposal will protect human health and the environment, comply with applicable or relevant and appropriate requirements (ARARs), and allow beneficial reuse of property on the ORR, particularly at the Oak Ridge National Laboratory (ORNL) and the Y-12 National Security Complex (Y-12).
The official administrative record is maintained by DOE. However, TDEC has uploaded key documents to provide background information to assist the public in understanding the process that resulted in the ROD, as well as ongoing efforts to design a protective landfill.

Informal Draft 0 (D0) Focused Feasibility Study, September 2011 - DOE provided the D0 report as an informal draft. It is not posted here because it was not subject to the document review protocols specified in the Federal Facility Agreement (FFA). TDEC provided informal comments to DOE via email. DOE, EPA, and TDEC met multiple times during 2011-2012 and were unable to resolve comments on the informal D0 report.
At this stage of the project, DOE called the proposed landfill the "CERCLA Disposal Facility (CDF)".

On December 7, 2017, the Dispute Resolution Agreement (DRA) for the D5 RI/FS stated that the Proposed Plan will include a TDEC/EPA approved Field Sampling Plan (FSP) as an appendix.
In accordance with the August 2017 SOW, which highlighted the need for data collection during the winter of 2017-2018, DOE prepared the D1 FSP in August 2017. DOE transmitted the D1 FSP to EPA and TDEC for review in October 2017. TDEC and EPA approved the D1 FSP in November 2017 to expedite data collection during the winter of 2017-2018. DOE revised the approved FSP from December 2017 through April 2018.

DOE completed a Performance Assessment (PA) and a Composite Analysis (CA) as parts of its internal process for evaluating proposed radioactive waste disposal, over which DOE has self-regulatory authority under the Atomic Energy Act of 1954, DOE Order 435.1: Radioactive Waste Management, and DOE Manual 435.1-1: Radioactive Waste Management Manual. Based on review of the PA and CA, DOE Headquarters approved construction of the proposed landfill by issuing a Preliminary Disposal Authorization Statement (PDAS). As noted in the PDAS, dated March 15, 2021 (see below), construction of the proposed EMDF still requires approval of a Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) Record of Decision (ROD) by the U.S. Department of Energy (DOE), the U.S. Environmental Protection Agency (EPA), and the Tennessee Department of Environment & Conservation (TDEC).
The state of Tennessee contracted subject matter experts (Neptune and Company, Inc.) to evaluate the PA and CA and help the state understand how possible future risks from the landfill may be minimized through the development of protective Waste Acceptance Criteria (WAC).
